<p><strong>Copy of Rental Agreement will be sent to you for Electronic signature after you Reserve a property. </strong></p> <p>You must be 21 years of age or older. You may not exceed the number of occupants allowed at anytime Occupants are adults and children added together.  If you are renting more than one property at the same time you understand by providing your Credit card information you are the solely and financially responsible for any damages from you or your guests.  No pets are allowed in non pet friendly homes at anytime.</p> <p><strong>Cancellations:</strong> Cancellations made 30 days or more prior to arrival with written notice (fax or e-mail acceptable) shall be given a full refund minus a $100.00 cancellation fee. Cancellations of less than 30 days prior to arrival shall forfeit the entire rent and sales tax unless Agent is able to re-rent the property. Refunds on any forfeiture will be issued the dollar value the unit is re-rented for during the same dates as the canceled reservation. There is no refund for early departure or refusal to occupy upon arrival or no shows.</p> <p><strong>Payments for a reservation are 50% at time of booking</strong> <strong>and the remaining balance is due 30 days prior to arrival.</strong> You will have the option to call us directly to make a payment by phone.  We accept Debit, Visa, MasterCard American Express or Discover drawn from a US bank.</p> <p><strong>Amenities: It is up to you to assure property has the amenities you desire prior to booking.</strong> Not all properties have high speed wireless internet or cable. If property does have this type of amenity it is for convenience only. No warranties or refunds are giving for this free amenity for outages, content, lack of content, speed, or access problems with your personal devices. <strong>Parking is mainly for vehicles</strong> if you are pulling a trailer of any kind you need to check to see if there is room to park both.</p> <p><strong>Arrival Details:</strong> Will be sent upon final payment and/or within 7 days of arrival, which include directions, your lock box codes, instructions and what you may want to bring for your trip.</p> <p><strong>Security deposit – Advanced Authorization For Damage:</strong> In lieu of collecting a security deposit, Tenant herby authorizes Agent to make such charges in the event of expenses caused by the acts or omissions of Tenant or Tenant’s Guests resulting in (i) damage to any of the real property or contents beyond ordinary wear and tear for the corresponding rental period, (ii) theft to any personal or real property of the owner, or (iii) unpaid balances, service fees or any other expenses due to violations by tenant of any terms of this agreement. It is tenant’s responsibility to report any issues concerns or damage upon arrival. Should property damage occur during a tenant’s stay, it must be reported immediately to Agent. Owner reserves the right to pursue all available legal remedies. If a flat fee is charged for a Security Deposit, it will be in this contract and returned to you within 30 days of departure providing there is no damage to the property. If the damage deposit exceeds the amount, we will charge the remainder due on the credit card on file.</p> <p><strong>No Smoking is allowed in the home/units or any enclosed area.</strong> You can smoke outside if you properly discard any remains. If smoking does occur inside the unit the tenant will be charged for all damage including, but not limited to, stains, burns, odors and removal of debris both inside and out.</p> <p><strong>Age Limit – House Parties – Occupancy: </strong> <strong>You must be 21 years of age or older to rent a property.</strong>  No Parties or over occupancy is allowed. Management reserves the right to enter the property to investigate any disturbances, check occupancy and/or check for damage. Agent reserves the right to ask for a driver’s license, for verification of age. In the event, a party is reported, during the corresponding rental period the Agent can terminate the Rental agreement, immediately vacate all occupants on the premises without a refund and charged additional fees. Falsified Reservations: Any reservation obtained under false pretenses will result in forfeiture of any advance payment, and check-in will not be permitted.</p> <p><strong>Holding Over & Early Arrivals or Late Departures:</strong>  Tenant agrees they will not arrive early, leave late, or remain at the property after check-out time. Any unauthorized holding over shall be subject to a charge of 1 and ½ times the daily prorated rent, plus any additional damage incurred including but not limited to the cost of alternative housing for arriving tenants displaced by tenants holding over.</p> <p><strong>No ATVs or utility vehicles allowed on Beach</strong>: If you are bringing an ATV to use elsewhere check to assure you have ample parking to have a vehicle and trailer.</p> <p><strong>Boats and Trailers</strong>: If you are bringing a boat and trailer you need to verify that you will have room to park both.  Most places have limited parking.</p> <p><strong>Towels/Linens: Bring personal towels.</strong> You are provided with a set per bathroom to use, which consists of 2 Bath towels, 1 hand towel, and 2 washcloths. Bedding/Linens are provided for each sleeping space.</p> <p><strong>Complimentary items:</strong> Dish soap, liquid hand soap, toilet tissue, 1 roll of paper towel and 1 or 2 garbage bags. Any items that are depleted during your stay will not be replenished.</p> <p><strong>Cleaning:</strong> Premises will be delivered to tenant in a professionally cleaned disinfected sanitized condition this service is performed by an independent contractor (not an employee of Perfect Landing). <strong>Tenant will assure the unit is left in a reasonably clean condition</strong> by wiping down all kitchen surface areas, including the inside of the microwave, stove, and refrigerator.  Wash dry and put away all dishes, utensils, collect and bag all trash and put in garbage containers.</p> <p><strong>Use of premises/Rules/Hold Harmless</strong>:  Tenant shall use the Premises as a Private Residence only. Tenant will comply with all laws, rules, ordinances, statutes, and orders regarding the use of the Premises. Tenant will not do any of the following, any of which shall constitute trespassing and subject Tenant and all occupants to immediate removal; (a) Harass, annoy, or endanger any other tenant or neighbor, or create any excessive noise, disturbance, annoyance or public nuisance, (b) Do anything to the structure or its surroundings that may be hazardous or that will cause the Landlord’s insurance to be cancelled or premiums to increase, (c) Tenant will not make waste of any utility this includes water electric and gas and propane. (d) Deface or damage, or allow another to deface or damage, any part of the premises. Accommodations and amenities are provided for your enjoyment. By using the premises, you assume responsibility and liability for your actions. Neither the property owner nor the Agent assumes any liability for accidents, injuries, loss, or theft of personal property. You are using the property at your own risk. In swimmable areas, there are no lifeguards on duty swim at your own risk. Tenant agrees to comply with all rules and regulations including those that are posted on the Premises.</p> <p><strong>Children: Tenant will always supervise children</strong> while using the Property and to take necessary precautions with children who may wet their beds, including utilizing plastic protection sheets or “Pull Ups”. Costs to replace mattresses or linens damaged by bed wetting is considered damage in which you will be charged for.</p> <p><strong>No Motor homes, Tents, campers, or RV hook ups, allowed.</strong></p> <p><strong>Pet Policy: No Pets are allowed in non-pet friendly properties.</strong> Only pet friendly properties allow a pet and require you to follow additional rules.</p> <p><strong>Maintenance: Tenant shall use and properly operate</strong> and safeguard the premises including but not limited to:  All furnishings both indoor and outdoor furniture, appliances, and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Tenant will report any malfunctioning item in a timely fashion. Pouring grease or any substances down the drains or flushing items that cause toilets to overflow or become blocked are prohibited. Tenant will pay for any drain blockages or stoppages caused by tenant, unless caused by defective plumbing, parts, or tree roots invading sewer lines.</p> <p><strong>Moving furniture indoor or outdoor or Alterations of the Property is prohibited</strong>: Tenant shall not alter any part of the premises or Move furniture. This includes but not limited to installing or fastening devices on any part of the home. Indoor & Outdoor Furniture to remain where you found it.</p> <p><strong>Grilling:</strong> If your unit comes with a Grill, grilling must be done in designated areas and away from any structure or building and never left unattended.  You the tenant are responsible for any damage due to any neglect or fires. If you are unsure how to use a grill, then do not use. Be sure to remove all food, empty any drip/grease pans after use. Propane tank if it is empty during your stay, it is up to you the tenant to refill.  Charcoal grills you will need to bring your own charcoal.</p> <p><strong>Firepits/Bon fires/Fireworks</strong>: If the property you are renting has a fire pit, all fires must be supervised and extinguished completely when not in use. No fires larger than 3-foot-high flame allowed.</p> <p><strong>Allergies:</strong> Tenant agrees that they are not entitled to a refund for any allergic reactions from any member of their party due to pollen, animals or environmental conditions.</p> <p><strong>Inclement Weather-Water Levels:</strong> Refunds will not be made due to inclement weather.  Water levels will vary. We cannot control bodies of water, acts of nature or damage to waterfront properties, decks or docks from any storms or acts of nature.</p> <p><strong>Keys to Property- Lost and found</strong>: Although we are not responsible for personal items missing or left behind, we will attempt to locate and return items to you at your expense (postage and administrative fee). Any items found are disposed of or donated after 30 days. If keys to home/unit are missing, you will be charged to re-key the home.</p> <p><strong>For Sale:</strong> If a property is for sale, the owner reserves the right to have his property shown to prospective buyers during the rental period.  Every effort will be made to schedule the showing at a reasonable and convenient time for all parties.</p> <p><strong>Disclosure</strong>: Perfect Landing Inc. acts as property manager/ agent for all Owner(s) and not as Agent for Tenant. In the event of an unforeseen circumstance, (although a rare occurrence), the agent reserves the right to move tenant to another rental unit of similar capacity and quality.</p> <p><strong>Errors:</strong> Every effort has been made to assure all descriptions and rates are accurate. Agent is not responsible for change in furnishings equipment or for printing errors. Advertised rates and specials are subject to change without notice. We reserve the right to make corrections to any errors or omissions due to human or computer errors.</p> <p><em><strong>If you have rented a Pet Friendly Property:</strong></em> (Pet implies Dog) Tenant will be granted permission by the managing agent to keep the pet specified under the following terms and conditions:</p> <p><strong>a. </strong>  <strong>No more than 1 Well behaved pet allowed</strong>, no dangerous vicious, or aggressive animal.<strong>  b. </strong>  Tenant is responsible for cleaning up and disposing of all pet refuse daily.  <strong>c.</strong>    Pet is not allowed on any furniture or beds.   <strong>d.</strong>   Pet will be under control of a responsible adult on a hand-held leash or in a pet carrier and never left unattended for any undue length of time. Tenant will prevent pets from engaging in behaviors creating excessive noise at a level that disturbs the surrounding neighbors.  <strong>e. </strong>   Tenant agrees to indemnify, hold harmless the Owner of said property and rental manager or rental manager’s agents against all liability, judgments, expenses (including attorney’s fees), or claims by third parties for any injury to any person or damage to property of any kind whatsoever caused by the tenant’s pet. <strong> f.  </strong>  Damages to the Leased premises caused by a pet must be repaired, cleaned and/or replaced at the Tenants expense. Damage is including but not limited to urine on carpet or furniture chew marks/claw marks on furniture flea’s infestation, screen damage shades curtains blinds or holes dug in yard, or any destruction of the property interior or exterior.</p>
